At Prime Recruitment Ltd, we are committed to providing a confidential service to our Clients who use our services, and staff members employed by the organisation.
Policy aim.
This policy sets out how Prime Recruitment Ltd expects its staff team to treat confidential information. It will apply to all employees, managers and the Directors of Prime Recruitment Ltd, who may have access to confidential information and a person’s personal data.
RESPONSIBILITY
It is the responsibility of the Manager and Director to bring the policy to the attention of all staff members and if requested that this policy is made available to the Client’s using the services of Prime Recruitment Ltd.
All staff members must ensure that they read this policy and ask for further information, if they do not understand. The staff member must also ensure that they understand the procedures and report any concerns straightaway to the Manager or Director. It is the responsibility of every staff member to ensure that they are working within this policy and to keep up to date with any changes in this policy that may affect their practice at work.
Confidential information.
This means that personal information or communication relating to our business, that is not known to others outside the organisation and is only shared between a small amount of people.
Examples of confidential information:
Individuals names, date of birth and addresses, documents created such as Care Plans by the Clients for the supplying of care to their services users, with personal information, financial and other documents that are confidential.
Prime Recruitment Ltd holds personal information regarding individual staff members and it is stored only for the purpose of which it was gathered for. This will not be disclosed to anyone outside Prime Recruitment Ltd without permission and in accordance with the Data Protection Act.
Obligations which apply to all Employees
All confidential information should always be locked away, stored securely and it should not be taken outside Prime Recruitment Ltd business premises, or from the Client’s premises.
Staff must never talk about confidential information relating to a Client’s Service user to family, friends or others not involved in their care, and report any concerns about an individual’s confidential information being breached to the Manager or Director at Prime Recruitment Ltd.
All paper documents and electronic data should be stored following the principles and guidance of the Data Protection Act 2018.
Information may only be disclosed to others when authorised by management.
Confidential information should never be used for personal profit or benefit.
Confidential information must not be replicated or stored on insecure devices such as a USB storage stick/pen.
These restrictions will continue to apply even when an employee has stopped working for Prime Recruitment Ltd.
All personal data will be dealt with sensitively and in the strictest confidence internally and externally.
Breaches of Confidentiality.
Prime Recruitment Ltd recognises that occasions may arise where individuals feel that they need to breach confidentiality. Confidential information or sensitive information relating to an individual may be divulged where there is a risk to an individual, an employee, volunteer or the general public and where there is a situation that is against the law to withhold it.
The duty of confidentiality is always subject to the legal requirements of the Public Disclose (Whistleblowing) Act 1998, providing that any disclose made is within the accordance and provisions of this Act.
Consequence of a deliberate breach of confidentiality.
Any employee of Prime Recruitment Ltd ,who deliberately breaches confidentiality, will face disciplinary action under Prime Recruitment Ltd’s disciplinary procedures. The breach or breaches of confidentiality may constitute to potential gross misconduct with may result in legal action with potential dismissal.
This policy continues to apply and is binding on all individuals when they have left Prime Recruitment Ltd’s employment.
All existing staff and new employees will be made aware of this confidentiality policy through induction and when they are trained.
Legislative Framework applying to confidentiality.
Prime Recruitment Ltd will monitor this policy to ensure that it meets the statutory and legal requirements, including the Data Protection Act 2018 and the General Protections Act 2018 and the General Data Protection Regulation, the Public Disclosure Act 1996, the Employment Right Act 1996, the Children’s Act 2004, the Rehabilitation of Offenders Act 1974 and the Prevention of Terrorism Act 2005.
Information will be provided to all staff on this policy, which will include information being provided with the legislation that applies to confidentiality.
